Regulation 2

(1)

Schedule 1A to the Extradition Act 1989 (application of the Act where 1995 or 1996 Convention applies)^f1 is amended as follows.

In section 14A(5), as inserted by paragraph 5 of Schedule 1A, for “magistrate” substitute “Senior District Judge (Chief Magistrate) or another District Judge (Magistrates' Courts) designated by him for the purposes of this Act”.

Omit paragraph 10(4) of Schedule 1A.

After the subsection inserted by paragraph 11(3) of Schedule 1A insert:

“(1B)

Where the foreign state has made a declaration under Article 6(3) of the 1996 Convention, fiscal offences, other than those connected with excise, value added tax or customs, are excluded from paragraph (ba) to (bd) of subsection (1) above.”.
