Article 3 Amendment of rule 4.4

In rule 4.4 (power to strike out a statement of case) after paragraph (1) insert—

“(1A)

When the court is considering whether to exercise the power to strike out a statement of case, it must take into account any written evidence filed in relation to the application or answer.”.
