Rule 7 Amendment of Part 11

(1)

In rule 11.4 (service of applications on notice)—

(a)

in paragraph (1)—

(i)

for “paragraph” substitute “paragraphs”; and

(ii)

after “(3)” insert “and (7)”;

(b)

in paragraph (3), for “Service” substitute “Subject to paragraph (7), service”; and

(c)

after paragraph (6) insert—

“(7)

This rule is subject to rule 6.23A (which specifies how service is to be effected on a person where there are reasonable grounds to believe that person is residing in a refuge).”.

(2)

In rule 11.7 (hearings and service of orders), in paragraph (3), after “must,” insert “subject to rule 6.23A,”.

(3)

In rule 11.8 (orders made by the court of its own initiative), after paragraph (3) insert—

“(Rule 6.23A specifies how service is to be effected on a person where there are reasonable grounds to believe that person is residing in a refuge.)”.
