Article 11 Transitional provisions relating to Human Fertilisation and Embryology

(1)

These Rules shall apply as far as practicable to an application for—

(a)

a parental order under section 30 of the Human Fertilisation and Embryology Act 1990; and

(b)

any order under the Adoption Act 1976 as modified by the Parental Orders (Human Fertilisation and Embryology) Regulations 1994^f1,

made and not disposed of before these Rules come into force.

(2)

Where, by reason of paragraph (1), these Rules do not apply to particular proceedings which have not been disposed of before these Rules come into force, the Family Proceedings Rules 1991 shall apply to those proceedings as if these Rules had not been made.

(3)

The court may give directions relating to the application of these Rules or the Family Proceedings Rules 1991 to proceedings in accordance with paragraphs (1) or (2) of this rule.
