Article 6 The Financial Services and Markets Act 2000 (Financial Promotion) Order 2005

The Financial Services and Markets Act 2000 (Financial Promotion) Order 2005^f1 is amended as follows.

In article 16(2)(a)(ii) (exempt persons), after “that section” insert “or in relation to which sections 20(1) and (1A) and 23(1A) of the Act^f2 do not apply by virtue of that section”.

In article 28B(1)(b)(ii) (real time communications: introductions)^f3, after “is exempt from the general prohibition” insert “or in relation to which sections 20(1) and (1A) and 23(1A) of the Act do not apply”.
