  "heading": "Interpretation",
  "text": "(1) In this Scheme—\n“application” means an application for grant under this Scheme and “applicant” will be construed accordingly;\n“the appropriate closing date” means such date as the Scottish Ministers may from time to time determine;\n“approval” means approval granted under paragraph 5 of this Scheme;\n“authorised officer” means any officer authorised in writing by the Scottish Ministers for the purposes of this Scheme;\n“authorised supplier” means a supplier of software to facilitate the electronic recording and transmission of fishing logbook, transhipment declaration and landing declaration data in accordance with Articles 15, 22 and 24 of the Control Regulation authorised by the Scottish Ministers and specified in a notice under paragraph 4(2);\n“Control Regulation” means Council Regulation (EC) No. 1224/2009 of 20 November 2009 establishing a Community control system for ensuring compliance with the rules of the common fisheries policy, amending Regulations (EC) No. 847/96, (EC) No. 2371/2002, (EC) No. 811/2004, (EC) No. 768/2005, (EC) No. 2115/2005, (EC) 2166/2005, (EC) No. 388/2006, (EC) No. 509/2007, (EC) No. 676/2007, (EC) No. 1098/2007, (EC) No. 1300/2008, (EC) No. 1342/2008 and repealing Regulations (EEC) No. 2847/93, (EC) No. 1627/94 and (EC) No. 1966/2006;\n“grant” means grant under this Scheme;\n“relevant condition” means any condition relating to the approval of an application which has been notified to the applicant under paragraph 5(1)(c);\n“relevant software” means software to facilitate the electronic recording and transmission of fishing logbook, transhipment declaration and landing declaration data in accordance with Articles 15, 22 and 24 of the Control Regulation; and\n“Scotland” and “the Scottish zone” have the same meaning as in section 126(1) of the Scotland Act 1998.\n(2) Any reference in this Scheme to anything done in writing or produced in written form includes a reference to an electronic communication, as defined in the Electronic Communications Act 2000, which has been recorded and is consequently capable of being reproduced.",
