Explanatory note
(This note is not part of the Regulations)
These Regulations apply to appeals under section 58 of the Friendly Societies Act 1992 (other than appeals where the friendly society concerned has its registered office in Scotland) in connection with certain decisions or determinations made by the Friendly Societies Commission. There are rights of appeal under that section in respect of the refusal or withdrawal of an authorisation, the imposition of conditions on an authorisation, the nature of any conditions imposed and the making of directions under section 51, 54 or 55 of the Act. There is also a right of appeal where, in the course of its deliberations relating to any authorisation, the Commission makes a determination that a person is not a fit and proper person to be an officer of a friendly society. Provision is made by the regulations as to the time and manner in which appeals are to be brought, the evidence and procedure at the hearing, the procedure after the hearing, the payment of costs of appeals and as to other miscellaneous matters connected with appeals.
