Article 36 Dishonoured cheques for fees

Changes not yet applied. Later legislation changes this provision in ways not yet written into the text below:

(1)

This rule applies where the appellant pays any fee by cheque and that cheque is subsequently dishonoured.

(2)

The Tribunal must serve a notice on the appellant requiring payment of the fee specifying the date by which the fee must be paid.

(3)

If the fee is not paid by the date specified in the notice—

(a)

the appeal will automatically be struck out without further order of the Tribunal; and

(b)

the appellant will be liable for the costs that any other party has incurred unless the Tribunal orders otherwise.
