Paragraph 13 Prohibition on withholding payment to workers

Changes not yet applied. Later legislation changes this provision in ways not yet written into the text below:

A licence holder must not withhold or threaten to withhold the whole or any part of any payment due to the worker in respect of any work done on any of the following grounds—

(a)

non-receipt of payment from the labour user;

(b)

the worker’s failure to prove that the worker has worked during a particular period of time (but this does not prevent the licence holder from satisfying itself by other means that the worker worked for the particular period in question);

(c)

the worker not having worked during any period other than that to which the payment relates; or

(d)

any matter within the control of the licence holder.
