The Secretary of State makes the following Regulations in exercise of the powers conferred by—

(a)

section 2(2) of the European Communities Act 1972^f1 being a minister designated^f2 in relation to measures relating to the control and regulation of genetically modified organisms for the purposes of that section, and
(b)

section 111(4) and (11) of the Environmental Protection Act 1990^f3, having consulted the Food Standards Agency in accordance with section 126(5) of that Act.
