Explanatory note

This Order amends the Higher Education Act 2004 (Commencement No.2 and Transitional Provision) Order 2005 (“the No.2 Order”) by substituting a new coming into force date for section 44(4) of the Education Act 2004 (which transfers to the National Assembly the power of the Secretary of State under section 23 of the Teaching and Higher Education Act 1998 to transfer or delegate student support functions under regulations made under section 22 of that Act).

That subsection, which under the No.2 Order was to have come into force on 1 September 2006, will now come into force on 23 June 2006.
