Regulation 6 Release from undertaking

A claimant shall not be taken to be in breach of the undertaking referred to in regulation 5—

(a)

if he is prevented from continuing to discharge that undertaking by reason of any material circumstance beyond his control; or

(b)

if he ceases to farm, but at least three hectares of the land in respect of which the undertaking was given continue to be used for the purposes of agriculture.
