# Housing and Regeneration Act 2008, Paragraph 3


The Secretary of State may by order extinguish any public right of way over land of the HCA or a strategic authority outside London if the Secretary of State is satisfied that—
(a) an alternative right of way has been, or will be, provided, or
(b) the provision of an alternative right of way is not required.
