Regulation 36 Offences

(1)

It is an offence for a person to breach regulation 11 or 12(1).

(2)

It is an offence for a person—

(a)

to fail to comply with an information notice;

(b)

in purported compliance with an information notice, to make a statement which—

(i)

that person knows to be false or misleading in a material particular; or

(ii)

is false or misleading in a material particular and that person is reckless that the statement is so false or misleading.

(3)

Proceedings for an offence under paragraph (1) or (2) may be taken, and the offence may be treated as having been committed, in any part of the United Kingdom.
