Regulation 5 Amendment of the Individual Learning Account (Scotland) Regulations 2011

(1)

Regulation 3 (qualifying persons (learning account holders)) is amended as follows.

For the associated cross heading substitute “Qualifying persons (Training Account Holders)”.

(3)

In paragraph (1)—

(a)

for “Learning Account Holder” substitute “Training Account Holder”;

(b)

for “ILA Scotland” substitute “ITA Scotland”; and

(c)

in sub-paragraph (b)—

(i)

omit “(5B),”; and

(ii)

for “and (6)” substitute “, (6) and (6A)”.

In paragraph (3)—

(a)

in sub-paragraph (f) for “Learning Account Holder” substitute “Training Account Holder”; and

(b)

after sub-paragraph (g) insert—

“; or

(h)

is a person not falling within sub-paragraphs (a) to (g) but—

(i)

is under the age of 18 and has lived in the United Kingdom throughout the seven-year period preceding the date of registration; or

(ii)

is aged 18 years old or above and, preceding the date of registration, has lived in the United Kingdom throughout either half of his or her life or a period of twenty years.”.

Omit paragraph (5B).

(6)

After paragraph (6) insert—

“(6A)

The condition in this paragraph is that the person is in employment or actively seeking employment.”.
