# Insolvency (Amendment) Act (Northern Ireland) 2026, Section 80: Vacancy in office of trustee

Status: prospective

(1) Article 273 (vacancy in office of trustee) is amended as follows.
(2) For paragraph (3) substitute—
“(3) The official receiver may ask the bankrupt’s creditors to appoint a person as trustee, and must do so if so requested by not less than one tenth in value of the bankrupt’s creditors.
(3A) If the official receiver makes such a request, the bankrupt’s creditors may in accordance with the rules appoint a person as trustee.”.
(3) In paragraph (4), for the words from “summoned” to “vacancy” substitute “asked, and is not proposing to ask, the bankrupt’s creditors to appoint a person as trustee”.
(4) In paragraph (8), for “the holding of a final meeting summoned under Article 304” substitute “the vacation of office by the trustee under Article 271(7)”.
