Regulation 2 Amendments to the Integrated Administration and Control System Regulations 1993

The Integrated Administration and Control System Regulations 1993^f1 shall be amended in accordance with the following paragraphs of this regulation.

The definition of “agricultural parcel” in regulation 2(1) shall be replaced by the following:

• ““agricultural parcel” has the same meaning as in Article 1(4) of Council Regulation 3508/92;”.

The following definition shall be inserted after the definition of “Commission Regulation 3887/92” in regulation 2(1):

• ““Commission Regulation 762/94” means Commission Regulation (EC) No. 762/94 laying down detailed rules for the application of Council Regulation 1765/92 with regard to the set-aside scheme^f2;”.

In the definition of Council Regulation 805/68 in regulation 2(1), replace “as amended by Council Regulation (EEC) No. 2066/92^f3” by “as amended by Council Regulations (EEC) Nos. 2066/92 and 125/93^f4 and Council Regulation (EC) No. 3611/93^f5”.

The following definitions shall be inserted after the definition of “Council Regulation 805/68” in regulation 2(1):

• ““Council Regulation 3013/89” means Council Regulation (EEC) No. 3013/89 on the common organisation of the market in sheepmeat and goatmeat^f6, as amended by Council Regulation (EEC) No. 2069/92^f7;

• “Council Regulation 2328/91” means Council Regulation (EEC) No. 2328/91^f8 on improving the efficiency of agricultural structures, as amended by Council Regulation (EEC) No. 870/93^f9;

• “Council Regulation 1765/92” means Council Regulation (EEC) No. 1765/92 establishing a support system for producers of certain arable crops^f10, as amended by Council Regulations (EEC) Nos. 364/93^f11 and 1552/93^f12 and Council Regulations (EC) Nos. 231/94^f13 and 232/94^f14, as read with Commission Regulation (EEC) No. 3738/92^f15;”.

In the definition of “specified payment” in regulation 2(1), substitute “Council Regulation 1765/92” for “Council Regulation (EEC) No. 1765/92 establishing a support system for producers of arable crops, as read with Commission Regulation 3738/92”, substitute “805/68, the” for “805/68 and the”, and insert at the end “, the premium in respect of sheep under Article 5 of Council Regulation 3013/89 and the compensatory allowance under Article 17 of Council Regulation 2328/91”.

Regulation 4 shall be replaced by the following:

“Minimum size of agricultural parcel

For the purposes of Article 4(7) of Commission Regulation 3887/92, the minimum size of an agricultural parcel in respect of which an application may be made shall be—

(a)

where that agricultural parcel consists of land set aside pursuant either to the obligation to set land aside set out in Article 2(5) of Council Regulation 1765/92, or to the option to set land aside set out in Article 7(6) of that Regulation, the size of the minimum area of land permitted to be set-aside under Article 3(1) of Commission Regulation 762/94;

(b)

where the agricultural parcel as defined in regulation 2(1) of these Regulations also constitutes an agricultural parcel as defined in regulation 2(1) of the Arable Area Payments Regulations 1994^f16, the minimum size parcel for which an arable compensatory payment (as defined in regulation 2(1) of those Regulations) may be made in respect of that parcel in conformity with regulation 5 of those Regulations;

(c)

where the agricultural parcel is sown with linseed and is used for seed production or research, 0.01 hectare; and

(d)

in all other cases, 0.1 hectare.”.

The following regulation shall be inserted after regulation 4:

“Reimbursement of specified payments

In any case where a farmer is obliged to reimburse all or part of any specified payment in accordance with Article 14(1) of Commission Regulation 3887/92, the amount so falling to be reimbursed shall be recoverable as a debt.”.
