  "heading": "Amount of the offender levy",
  "text": "(1) The offender levy for the purposes of section 1 is—\n(a) £50, where the sentence imposed on the offender is or includes—\n(i) a determinate sentence of imprisonment or detention for more than 2 years (not being a suspended sentence); or\n(ii) an indeterminate sentence of imprisonment or detention;\n(b) £25, where that sentence—\n(i) is or includes a determinate sentence of imprisonment or detention for 2 years or less (not being a suspended sentence); and\n(ii) does not include a sentence falling within paragraph (a);\n(c) £20, where that sentence—\n(i) is or includes a community order or a suspended sentence of imprisonment or detention; and\n(ii) does not include a sentence falling within paragraph (a) or (b);\n(d) £15, where that sentence—\n(i) is or includes a fine; and\n(ii) does not include a sentence falling within paragraph (a), (b) or (c).\n(2) The offender levy for the purposes of section 5 is £5.\n(3) The Department may by order amend subsections (1) and (2).\n(4) No order shall be made under subsection (3) unless a draft of the order has been laid before, and approved by a resolution of, the Assembly.",
