Explanatory note
(This note is not part of the Order)
This Order replaces the Land Registration Fee Order 2004 (as amended by the Land Registration Fee (Amendment) Order 2004). It makes changes to land registration fees.
The main changes made by the Order are:
The fee of £80 payable for each registered title affected on an application for the determination of the exact line of a boundary has been replaced with a single fee of £80 (paragraph (13) of Part 1 of Schedule 3).
The fees for inspection and for official copies of the register and of documents have been increased as follows (Part 2 of Schedule 3):
The fees for inspection of an individual register or caution register, or a title or caution plan, or an individual register and title plan of a commonhold common parts title have been increased from £2 to £3, when from a remote terminal (as defined in article 1(2)), and from £4 to £6 in other cases.
The fees for inspection of any or all documents referred to in an individual register or of any other document kept by the registrar which relates to an application to him (other than, in each case, leases) have been increased from £2 to £5, when from a remote terminal, and from £4 to £10 in other cases. There are now fees relating specifically to inspection of leases referred to in an individual register and these increase the fees that applied previously from £2 to £10, when from a remote terminal, and from £4 to £20 in other cases.
The fees for an official copy of an individual register or caution register, or a title or caution plan, or an individual register and title plan of a commonhold common parts title have been increased from £2 to £3, when requested in electronic form from a remote terminal, and from £4 to £6 when requested in paper form by any permitted means.
The fees for an official copy of any or all documents referred to in an individual register (other than leases) have been increased from £2 to £5, where a copy in electronic form is requested from a remote terminal, and from £4 to £10 when requested in paper form by any permitted means.
There are now fees relating specifically to an official copy of a lease referred to in an individual register and these increase the fees that applied previously from £2 to £10, where a copy of the lease is held in electronic form and the request for a copy in electronic form is from a remote terminal, and from £2 or £4 to £20, where a copy of the lease is not held in electronic form or where a copy in paper form is requested by any permitted means.
The fees for an official copy of any other document kept by the registrar which relates to an application to him have been increased from £2 to £5, where a copy of the document is held in electronic form and the request for a copy in electronic form is from a remote terminal, and from £4 to £10 where a copy of the document is not held in electronic form or where a copy in paper form is requested by any permitted means.
The fees for official searches of the register, of pending first registration applications and of the index of relating franchises and manors have been increased from £2 to £3, when requested from a remote terminal, and from £4 to £6 in other cases. The fee for the issue of certificates of inspection of a title plan has also been increased from £4 to £6 (Part 3 of Schedule 3).
The Land Registration Fee Order 2004 (Part 4 of Schedule 3) prescribed a fee of £40 for an application for an official copy of an exempt information document under rule 137 of the Land Registration Rules 2003. This provision has not been carried forward and the general provisions regarding fees for documents in Part 2 of Schedule 3 now apply.
A full regulatory impact assessment has not been produced for this instrument, as it has no impact on the costs of business.
