Explanatory note
(This note is not part of the Order)
This Order replaces the Land Registration Fee Order 2021 (S.I. 2021/1226) (‘the 2021 Order’). It makes changes to some land registration fees.
The main changes made by the Order are:
An increase of £4 in the fees for inspection, copying, searches and other information services (parts 2 and 3 of Schedule 3)
The definition of “electronic means” in article 1(1) has been amended to exclude email. This means that (with one exception) the fee for applications lodged by email will not qualify for the lower fee for electronic applications.
The amendment of article 9 to provide that an application made under rule 140 of the Land Registration Rules 2003 which is lodged by email will continue to benefit from the lower fee applicable to applications lodged by electronic means. This is the exception referred to in paragraph 2 above.
The amendment of article 13 to confirm that fees shall be paid in money and that, where an application is delivered other than by electronic means, email, personal delivery, orally or by telephone, a method of payment other than direct debit, cheque or postal order could be accepted, if permitted by the registrar. In practice, this is limited to applications made by post or Document Exchange and may apply in a very small number of cases.
