# The Land Registration Fees Order 1991, Note: Explanatory note

(This note is not part of the Order)
The Order, which, as from 1st November 1991, supersedes the Land Registration Fees (No. 2) Order 1990 (“the 1990 order”), revises the land registration fee scales and makes certain other changes.
The fees under the principal fee scales, Scales A and B, are increased so that Scale A rises from a minimum fee of £35 in relation to values not exceeding £25,000, up to a maximum fee of £1,200 in relation to values exceeding £10,000,000, and Scale B rises from a minimum fee of £35 in relation to rents not exceeding £2,500, up to a maximum fee of £650 in relation to rents exceeding £50,000.
The other changes include:
(1) The fee for fixed fee applications is increased from £30 to £35, in line with the minimum scale fee (provisos to article 2(2), article 7(1), article 12 and Schedule 3, Part I);
(2) Where a sale and sub-sale are effected by separate instruments of transfer, provision is made for separate fees to be paid in respect of each transfer (proviso (a) to article 2(3));
(3) The provision applying a fixed fee for each separate area of land or registered title comprised in certain large scale applications is amended by the addition of definitions for the expressions “large scale application” and “unit of land” and so that the minimum number of units of land (as defined) to which the provision applies is reduced to 20 and the fixed fee is increased to £20 for each such unit of land (article 6);
(4) The maximum fee for an application in Form 112A or Form 112B in the Schedule to the Land Registration (Open Register) Rules 1990 (applications for information in relation to criminal investigations and insolvencies) is increased to £175 (article 7(2));
(5) The fee of £30 per title affected for an application to register or modify a caution, restriction, notice or inhibition with a maximum fee for any one application is replaced by a fee of £35 for the first title affected and a fee of £20 for each subsequent title affected (article 7(1) and paragraph (1) of Schedule 3, Part I);
(6) In relation to applications under rule 271 of the Land Registration Rules 1925 (lost certificates) a reduced fee of £20 is payable where a replacement certificate is not issued (article 7(1) and paragraph (4) of Schedule 3, Part I);
(7) Where fixed fees of £6 and £12 are specified under the 1990 Order for particular services these are increased to £7 and £14 respectively (article 7(1) and Schedule 3, Part II);
(8) Separate fees of £7 are payable in respect of applications for personal inspection of each of the register, the filed plan and any or all of the documents referred to in the register (article 7(1) and paragraph (2) of Schedule 3, Part II);
(9) The fee of £6 per application for a search of the Index Map is replaced by a fee of £7 for each title in respect of which a result is given or a fee of £7 where no part of the land to which the search relates is registered (article 7(1) and paragraph (9) of Schedule 3, Part II);
(10) A fee of £70 is prescribed for the supply of a copy of an Index Map section (articles 1(2) and 7(1) and paragraph (11) of Schedule 3, Part II);
(11) A fee of £14 per title is prescribed for the supply of information under section 129 of the Land Registration Act 1925 (article 7(1) and Schedule 3, Part II).
