  "heading": "Preliminary issues",
  "text": "(1) The President or the Tribunal may, on the application of any party to proceedings, order any preliminary issue in the proceedings to be disposed of at a preliminary hearing.\n(2) If in the opinion of the Tribunal the decision on the preliminary issue disposes of the proceedings, it may order that the preliminary hearing shall be treated as the hearing of the case or may make such other order as it thinks fit.\n(3) Paragraphs (2) to (7) of rule 38 shall apply to an application under paragraph (1) above as if for “registrar” in those paragraphs there were substituted “President”.",
