# The Local Government (Structural Changes) (Transitional Arrangements) (No.2) Regulations 2008, Regulation 26: Application of Part 6 of the Local Government and Housing Act 1989 and Part 7 of the Localism Act 2011

Extent: E+W

(1) The relevant provisions shall have effect, in relation to functions falling to be discharged under that Part before the reorganisation date and as regards the financial year beginning on 1st April 2019, by or in relation to a preparing council which is a county council, or by or in relation to a shadow council, as if the council were a local housing authority within the meaning of that Part.
(2) In relation to functions falling to be discharged as mentioned in paragraph (1), the relevant provisions shall have effect as if a predecessor council were not a local housing authority.
(3) In this regulation “the relevant provisions” means—
(a) Part 6 of the Local Government and Housing Act 1989 (housing finance); and
(b) sections 171, 172, 173 (insofar as that section relates to a determination under section 171) and 175 of the Localism Act 2011 (limits on indebtedness).
