Regulation 38 Offences

(1)

Any owner who contravenes regulation 36(1) shall be guilty of an offence and liable on summary conviction to a fine not exceeding level 5 on the standard scale.

(2)

In any proceedings for an offence under this Part of these Regulations it shall be a defence to prove that the person charged took all reasonable steps to ensure that the Regulations were complied with.
