The Secretary of Statef1 makes these Regulations in exercise of the powers conferred by sections 31 and 60 of, and paragraph 5 of Schedule 7 to, the Electricity Act 1989f2.

The functions of the Director General of Electricity Supply were transferred to the Gas and Electricity Markets Authority by section 3 of the Utilities Act 2000 (c. 27); section 95(1) of the Energy Act 2008 (c. 32) transferred the functions of the Gas and Electricity Markets Authority to the Secretary of State.
