# The Montserrat Constitution Order 1989, Paragraph 34: Incapacity of nominated members.


The Governor acting in his discretion may, by instrument under public seal, declare a nominated member of the Legislative Council to be, by reason of illness, supported by medical opinion, temporarily incapable of performing his functions as a member of the Council and thereupon such member shall not perform his said functions until he is declared, in manner aforesaid, again to be capable of performing them.
