Explanatory note

These Regulations amend the Motor Vehicles (EC Type Approval) Regulations 1998 (“the 1998 Regulations”).

Directive 70/220/EC^f1 on the approximation of the Laws of the Member States on measures to be taken against Air Pollution by emissions from motor vehicles (a “separate Directive” specified in Schedule 1 to the 1998 Regulations) has been amended by Commission Directive 2002/80/EC. Regulation 2 inserts reference to Directive 2002/80/EC at the appropriate place in the table in Schedule 1 to the 1998 Regulations, thereby implementing that Directive for the purposes of EC type approval procedures. Directive 2002/80/EC adapts Directive 70/220/HC to technical progress. It clarifies references made by previous Directives in respect of the marking and packaging of replacement catalytic converters and also in respect of the functioning of on board diagnostic systems.

In line with the 1998 Regulations, the use of the symbol * denotes that the Directive specified is a Commission Directive.

This Explanatory Note incorporates the Transposition Note that would otherwise have been provided separately.
