Article 21 Notification to appellant before determination

Original text. Later amendments are not shown.

(1)

Where a party to the appeal and his representative have been excluded from the hearing of the appeal or any part of it, the Tribunal shall, before it makes a determination, give that party a summary of the submissions and evidence received in his absence if and to the extent it is possible to do so without disclosing information contrary to the public interest.

(2)

Where the Tribunal provides such a summary, it shall afford the special advocate and the parties an opportunity to make representations and adduce evidence or further evidence to the Tribunal in respect of the material contained in it.
