Section 11 Powers of entry, inspection and production of documents
Any individual, who in the opinion of the Health Board is suitably qualified to undertake any inspection with which this and the succeeding regulation are concerned, may be authorised by name and in writing by the Health Board to act in accordance with these Regulations, and the expression “authorised person” shall be construed accordingly.
Subject to paragraph (3), an authorised person, on producing, if asked to do so, his document of authorisation—
may, at all reasonable times, enter and inspect any premises which are used, or which he reasonably believes are used, for the purposes of a nursing home;
may, in respect of a nursing home registered under the Act, require the person registered to produce any register or record required in terms of these Regulations to be maintained, and may inspect any such register or record.
Nothing in this regulation shall enable an authorised person, other than a medical practitioner employed by the Health Board, to inspect any medical record relating to a patient in a nursing home or in premises believed to be used as such.
