# The Organic Products Regulations 2009, Regulation 20: Offence due to fault of another person

Extent: E+W+S+NI

(1) Where the commission by a person (“A”) of an offence under regulation 18 is due to the act or default of another person (“B”), B is guilty of the offence.
(2) B may be charged with and convicted of the offence whether or not proceedings are taken against A.
