Article 6 Time limit for appealing

Subject to paragraph (3) a notice of appeal must be served on the Commission no later than six months from the day on which the Secretary of State gave directions under section 64 of the 2001 Act.

The notice of appeal shall be taken to have been served on the day on which it is received by the Commission at the address or fax number specified in the directions against which the appeal is made.

The Commission may accept a notice of appeal served after the expiry of the period permitted by paragraph (1) if it is of the opinion that, by reason of special circumstances, it is just and right to do so.
