Article 10

In rule 23 (death of appellant before hearing), for paragraph (3) there shall be substituted—

“(3)

In such a case, if the appeal was an entitlement appeal and the designated person proceeds with it on behalf of the appellant, it shall be heard at the same time and by the same tribunal as any appeal brought by the designated person in respects of the appellant’s death.”
