# Planning Act 2008, Section 31: When development consent is required


(1) Consent under this Act (“development consent”) is required for development to the extent that the development is or forms part of a nationally significant infrastructure project.
(2) But see section 35B (power for the Secretary of State to give a direction disapplying the requirement for development consent).
