  "text": "(1) In Schedule 5, in paragraph 1(1) for “consisting of the winning and working of minerals” there is substituted\n“—\n(a) consisting of the winning and working of minerals; or\n(b) involving the depositing of mineral waste,”.\n(2) In sub-paragraphs (2), (3) and (5) of that paragraph for “development”, in each place where it occurs, there is substituted “ winning and working of minerals or the depositing of mineral waste ”.\n(3) In sub-paragraph (6) of that paragraph “consisting of the winning and working of minerals” is omitted.\n(4) In paragraph 2(1) of that Schedule—\n(a) in paragraph (a) after “minerals” there is inserted “ or involving the depositing of refuse or waste materials ”; and\n(b) in paragraph (b) for “operations for the winning and working of minerals have been completed” there is substituted “ the winning and working is completed or the depositing has ceased ”.\n(5) In paragraph 6 of that Schedule for the words from “carried out” to “under the land” there is substituted “ won and worked minerals or deposited refuse or waste materials ”.\n(6) In paragraph 7 of that Schedule after “minerals” there is inserted “ or involving the depositing of refuse or waste materials ”.\n(7) At the end of that Schedule there is inserted—\n“ Interpretation\n9 In this Schedule any reference to a mineral planning authority shall be construed, in relation to the exercise of functions with respect to the depositing of refuse or waste materials (other than mineral waste), as a reference to the authority entitled to discharge such functions.”",
