# The Plant Protection Products (Amendment) Regulations 1998

These Regulations further amend the Plant Protection Products Regulations 1995 (S.I. 1995/887), as amended (S.I. 1996/1940, 1997/7 and 1997/2499), (“the principal Regulations”) which implement in Great Britain Council Directive 91/414/EEC concerning the placing of plant protection products on the market (OJ No. L230, 19.8.91, p. 1 as read with OJ No. L170, 25.6.92, p. 40) (“the Directive”), as amended.

The Minister of Agriculture, Fisheries and Food and the Secretary of State being Ministers designated for the purposes of section 2(2) of the European Communities Act 1972 in relation to the common agricultural policy of the European Community, acting jointly in exercise of the powers conferred on them by the said section 2(2), and of all other powers enabling them in that behalf, and, in respect of regulation 3 of the following Regulations, the Minister of Agriculture, Fisheries and Food in exercise of the powers conferred by section 56(1) and (2) of the Finance Act 1973 with the consent of the Treasury, hereby make the following Regulations:

## 1 Title and commencement

These Regulations may be cited as the Plant Protection Products (Amendment) Regulations 1998 and shall come into force on 11th December 1998.

## 2 Amendment of the Plant Protection Products Regulations 1995

Regulation 2(1) of the Plant Protection Products Regulations 1995 shall be amended by substituting for the definition of “the Directive” the following definition–
““the Directive” means Council Directive 91/414/EEC concerning the placing of plant protection products on the market, as amended by–
(a) Commission Directive 93/71/EEC;
(b) Commission Directive 94/37/EC;
(c) Commission Directive 94/79/EC;
(d) Commission Directive 95/35/EC;
(e) Commission Directive 95/36/EC;
(f) Commission Directive 96/12/EC;
(g) Commission Directive 96/46/EC;
(h) Commission Directive 96/68/EC;
(i) Council Directive 97/57/EC;
(j) Commission Directive 98/47/EC;”.

## 3 Amendment of the Plant Protection Products (Fees) Regulations 1995

Regulation 2 of the Plant Protection Products (Fees) Regulations 1995 shall be amended by substituting for the definition of “principal Regulations” the following definition–
““principal Regulations” means the Plant Protection Products Regulations 1995 as amended by–
(a) the Plant Protection Products (Amendment) Regulations 1996;
(b) the Plant Protection Products (Amendment) Regulations 1997;
(c) the Plant Protection Products (Amendment) (No. 2) Regulations 1997;
(d) the Plant Protection Products (Amendment) Regulations 1998;”.

## Explanatory note

(This note is not part of the Regulations)
These Regulations further amend the Plant Protection Products Regulations 1995 (S.I. 1995/887), as amended (S.I. 1996/1940, 1997/7 and 1997/2499), (“the principal Regulations”) which implement in Great Britain Council Directive 91/414/EEC concerning the placing of plant protection products on the market (OJ No. L230, 19.8.91, p. 1 as read with OJ No. L170, 25.6.92, p. 40) (“the Directive”), as amended.
The Regulations amend the definition of the Directive provided in the principal Regulations in consequence of Commission Directive 98/47/EC (OJ No. L191, 7.7.98, p. 50) which includes an active substance (azoxystrobin) in Annex I to the Directive. They also make a consequential amendment to the Plant Protection Products (Fees) Regulations 1995 (S.I. 1995/888), as amended (S.I. 1997/884).
