Explanatory note
(This note is not part of the Regulations)
Section 8 of the Rent Act 1977 excepts from the definition of “protected tenancy” in section 1 thereof a tenancy granted to a student, or prospective student, at an educational institution specified for the purposes of the section by regulations if the tenancy is granted by such an institution or by a body so specified.
These regulations amend the regulations made in 1986 under that section. The principal changes are—
to take into account the provisions of the Education Reform Act 1988 by adding to the list of specified educational institutions those within the PCFC funding sector as defined in that Act; and
to add to the specified bodies by whom non-protected tenancies may be granted to students of specified educational institutions those named in regulation 2(c) of these regulations.
