# The REACH Enforcement Regulations 2008, Paragraph 5

Extent: E+W+S+N.I.

A sheriff must not make an order setting aside a suspension notice unless the sheriff is satisfied at the date of the order that proceedings—
(a) for an offence under regulation 11 or 13; or
(b) for forfeiture of the goods under section 3 of Part 3 of Schedule 6,
have not been brought or, having been brought, have been concluded.
