# Registered Designs Act 1949, Paragraph 11: Applications for registration pending immediately before IP completion day


(1) In this Part references to an existing EU application are to an application for registration of a design under the Community Design Regulation in respect of which the conditions in sub-paragraph (2) are satisfied.
(2) The conditions referred to in sub-paragraph (1) are that immediately before IP completion day—
(a) the application has been accorded a filing date pursuant to Article 38; and
(b) the application has been neither granted nor refused by the European Union Intellectual Property Office.
