Article 42 Procedure for application for registration
An application under section 19(1) or (2) for the registration of the title of any person becoming entitled by assignment, transmission or operation of law to a registered design or to a share in a registered design, or becoming entitled as mortgagee, licensee or otherwise to any interest in a registered design shall be made on Designs Form 12A.
An application under paragraph (1) above shall—
where it relates to an assignment as mentioned in section 19(1) or (2), be signed by or on behalf of the parties thereto;
where it relates to a mortgage or the granting of a licence as mentioned in section 19(1) or (2), be signed by or on behalf of the mortgagor or the grantor of the licence, as the case may be;
or be accompanied by such documentary evidence as suffices to establish the assignment, transmission or operation of law.
The registrar may direct that such evidence as he may require in connection with the application should be furnished within such period as he may specify.
