# The River Humber (Upper Burcom Tidal Stream Generator) Order 2008, Article 12: Offences


If the undertaker, without reasonable excuse, fails to—
(a) comply with a direction given under article 6, 9 or 10; or
(b) give notification as required by article 6,
it shall be guilty of an offence and liable on summary conviction to a fine not exceeding level 3 on the standard scale.
