# Road Traffic Act 1991, Section 40: Power to install equipment for detection of traffic offences.


(1) In Part V of the Highways Act 1980 immediately before section 96 there shall be inserted—
“ Power to install equipment for detection of traffic offences.
95A A highway authority may install and maintain on or near a highway structures and equipment for the detection of traffic offences.”
(2) In Part IV of the Roads (Scotland) Act 1984 after section 49 there shall be inserted—
“ Equipment for detection of traffic offences
Power to install equipment for detection of traffic offences.
49A A roads authority may install and maintain on or near a road structures and equipment for the detection of traffic offences.”
