  "text": "(1) For the purposes of the provisions mentioned in paragraph (2), it is immaterial whether there is a finding of fact in any proceedings.\n(2) The provisions are—\n(a) Article 37(3)(b) and (c);\n(b) Article 38(4)(b) and (c);\n(c) Article 41(2)(b) and (c) and (5)(a);\n(d) Article 43(2)(b) and (c) and (5)(a);\n(e) Article 47(2)(b) and (c) and (5)(a).",
