# The Scotch Whisky Regulations 2009, Regulation 34: Amount of penalty

Extent: E+W+S+N.I.

(1) The amount of the penalty must be determined by the enforcement authority and must neither be less than £1,000 nor more than £4,000.
(2) The factors to be taken into account by the enforcement authority in determining the amount of the penalty may include (but are not limited to) one or more of the factors mentioned in Schedule 4.
