Paragraph 65 REPONING

Changes not yet applied. Later legislation changes this provision in ways not yet written into the text below:

Where, by reason of the failure of an Applicant or Respondent to lodge any statement or pleading or to produce any writing, plan, book or excerpt from a book, or other document or article or to appear at a hearing or to obey any Order of Court or by reason of any other default, an Order has been pronounced (1) dismissing the Application or (2) repelling any pleas or objections or claims, the party in such default may within thirty days from the date of intimation of such Order move the Court to be reponed against such Order; and the Court, if satisfied that such default occurred through mistake or inadvertence or was in the circumstances excusable, may, upon such terms and conditions as to expenses or further hearing or otherwise as they shall think just, recall such Order and appoint the Application to proceed as if such default had not occurred.
