The Secretary of State has consulted with representatives of such interests as appear to the Secretary of State to be concerned with these Regulations in accordance with section 16(1) of that Act.

1964 c. 14. Section 16(1) was amended, and section 16(1A) was inserted, by paragraph 5 of Schedule 4 to the European Communities Act 1972 (c. 68). The powers in the Plant Varieties and Seeds Act 1964, when read with paragraph 5 of Schedule 8 to the European Union (Withdrawal) Act 2018 (c. 16) allow for modifications to be made to “retained direct minor EU legislation” as defined in section 7(6) of the Act. See section 38(1) of the Plant Varieties and Seeds Act 1964 for the definition of “the Minister”.
