  "heading": "Requirements in relation to use for non-agricultural purposes",
  "text": "(1) Where a beneficiary has undertaken to use any set-aside land for non-agricultural purposes, that beneficiary shall, until the conversion of that land to use for non-agricultural purposes commences, observe in relation to that land the requirements set out in Schedule 2.\n(2) Where a beneficiary has undertaken to use any set-aside land for non-agricultural purposes, that beneficiary shall not use that land for—\n(a) the extraction of minerals; or\n(b) the erection of any building or other permanent structure with a view to the use of such building or structure for any of the following purposes—\n(i) the carrying-on of any industrial process;\n(ii) the retail or wholesale sale of goods;\n(iii) use as a dwellinghouse, hotel or lodging house or for the purposes of a residential institution of any description;\n(iv) use for office accommodation;\n(v) use as a storage or distribution centre.\n(3) Notwithstanding paragraph (2) above, a beneficiary may use set-aside land for the erection of any building or other permanent structure with a view to the use of that building or structure for the purposes of any business of a type specified in the Schedule to the Farm Business Specification Order 1987 where that business is carried on by a person also carrying on a business consisting in or partly in the pursuit of agriculture on the same or adjacent land.",
