Coming into operation in accordance with Article 1

The Secretary of State, in exercise of the powers conferred on him by section 12(2) and (3) of the Sheriff Courts (Scotland) Act 1971^f1 and of all other powers enabling him in that behalf, and after considering a report made to him by the Lord President of the Court of Session and the Lord Justice Clerk under section 12(1) of that Act to the effect that Sheriff Ewen Stewart is unfit for the office of sheriff by reason of inability, hereby makes the following Order:
