# The Social Security (Personal Independence Payment) Regulations 2013, Paragraph 2


Paragraph (1)(a) does not include any person who –
(a) has previously been an insured person under Part 1 of the National Insurance Act 1965 ; or
(b) is paying or has previously paid one or more of the following classes of contributions under the Social Security Act 1975 or the Social Security Contributions and Benefits Act 1992 –
(i) primary Class 1;
(ii) Class 2; or
(iii) Class 3.
