Regulation 7 Saving provision

The amendments made by regulation 4(3) to (6) of these Regulations do not apply to a person who—

(a)

was a—

(i)

relevant DLA entitled person as defined by regulation 2ZA of the Social Security (Disability Living Allowance) Regulations 1991 before that provision was substituted by regulation 4(5) of these Regulations, or

(ii)

a new DLA claimant as defined by regulation 2ZB of the Social Security (Disability Living Allowance) Regulations 1991 before that provision was amended by regulation 4(6) of these Regulations, and

(b)

became permanently resident in Scotland—

(i)

on or after 7th July 2023, but

(ii)

before 23rd February 2026.
