Regulation 5 Offences and penalties

Subject to paragraph (2) below, if any person contravenes, or fails to comply with, any specified Community provision he shall be guilty of an offence and liable on summary conviction to a fine not exceeding the statutory maximum or on conviction on indictment to a fine.

Paragraph (1) above shall not apply in any case to which Article 1 of Commission Regulation (EEC) No 3773/89 laying down transitional measures relating to spirituous beverages^f1 applies.
